Ensign, DeMint to Force Vote on Health Care Bill Unconstitutionality

December 22, 2009 – WASHINGTON, D.C. – Today, U.S. Senators Jim DeMint (R-South Carolina) and John Ensign (R-Nevada), raised a Constitutional Point of Order on the Senate floor against the Democrat health care takeover bill on behalf of the Steering Committee, a caucus of conservative senators. The Senate will vote tomorrow on the bill’s constitutionality.

“I am incredibly concerned that the Democrats’ proposed individual mandate provision takes away too much freedom and choice from Americans across the country,” said Senator Ensign. “As an American, I felt the obligation to stand up for the individual freedom of every citizen to make their own decision on this issue. I don’t believe Congress has the legal authority to force this mandate on its citizens.”

“Forcing every American to purchase a product is absolutely inconsistent with our Constitution and the freedoms our Founding Fathers hoped to protect,” said Senator DeMint. “This is not at all like car insurance, you can choose not to drive but Americans will have no choice whether to buy government-approved insurance. This is nothing more than a bailout and takeover of insurance companies. We’re forcing Americans to buy insurance under penalty of law and then Washington bureaucrats will then dictate what these companies can sell to Americans. This is not liberty, it is tyranny of good intentions by elites in Washington who think they can plan our lives better than we can.”

Americans who fail to buy health insurance, according to the Democrats’ bill, would be subject to financial penalties. The senators believe the bill is unconstitutional because the insurance mandate is not authorized by any of the limited enumerated powers granted to the federal government. The individual mandate also likely violates the “takings” clause of the 5th Amendment.

The Democrats’ healthcare reform bill requires Americans to buy health insurance “whether or not they ever visit a doctor, get a prescription or have an operation.” If an American chooses not to buy health insurance coverage, they will face rapidly increasing taxes that will rise to $750 or 2% of their taxable income, whichever is greater.

The Congressional Budget Office once stated “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States.”

A legal study by scholars at the nonpartisan Heritage Foundation concluded: “An individual mandate to enter into a contract with or buy a particular product from a private party, with tax penalties to enforce it, is unprecedented– not just in scope but in kind–and unconstitutional as a matter of first principles and under any reasonable reading of judicial precedents.”

Statement by Texas Attorney General Greg Abbott related to the Senate’s Health Care Bill

Provision appears to give Nebraska a permanent exemption from paying the Medicaid expenses all other states in the nation will be required to pay.

“The Nebraska Compromise, which permanently exempts Nebraska from paying Medicaid costs that Texas and all other 49 states must pay, may violate the United States Constitution–as well as other provisions of federal law. In light of this unprecedented and highly questionable backroom deal, Texas will join South Carolina and other states in an effort to thoroughly review the constitutionality and legality of the Nebraska Compromise. Because it disadvantages Texas taxpayers, the Texas Attorney General’s Office will explore all available avenues to challenge and overturn this legally problematic provision. Our democratic system of government depends upon transparency and openness–this backroom deal goes too far and must be challenged because Texas deserves better.”

TCGOP Candidate Platform Review

In an effort to address  grassroots frustrations with candidates and officeholders who run for office under our Party banner, yet lack an understanding of Republican principles, Rule 43 was adopted by the delegates at the 2008 Texas Republican Convention.

To comply with Rule 43, all candidates filing to run in the 2010 Tarrant County Republican Primary will be given a copy of the Texas Republican Platform to read, and a Candidate Platform Review Form which asks candidates if they agree, disagree or are undecided on 10 core Republican issues.  Candidates are also asked to affirm that they have read the Texas Republican Platform.  All responses obtained locally will be kept on file at Tarrant County Republican Headquarters.

It is understood that Judicial Candidates will not be able to complete the questions on the 10 core Republican issues. You are however, encouraged to read the Platform and sign the affirmation stating you have done so.

Critical Vote on Healthcare Expected Saturday

After months working in secret behind closed doors, Harry Reid this week finally unveiled his 2,074-page government-run health care plan. His plan would increase health care premiums, increase taxes on families and small businesses by half a trillion dollars, cut Medicare by another half trillion dollars, and allow federal funds to be used for abortions.

Harry Reid has scheduled a critical vote this Saturday night that will allow the Senate to take-up his bill. If that vote succeeds, Harry Reid will be dangerously close to finally imposing President Obama’s government-run health care scheme on America

Please  call  the Senators listed below. Aske  your  family and friends in other states  to also call their Senators and tell them to vote “NO”, especially those who reside in the in the following states. These Senators are on the fence. We need to push them off onto the “NO” side.
